For the second time in 2009 a man has died after being shot with a Taser and struggling with local law enforcement during an arrest.
According to the Kern County Sheriff’s Department, on Thursday at about 12:45 a.m., a deputy was flagged down by a 20-year-old female in the area of E. Belle Terrance and S. Union Ave. Officials said the woman told the deputy she was just assaulted by her husband, a 25-year-old male, who she said was armed with a baseball bat.
Officials said the woman had minor injuries and declined medical aid. She told the deputy that her husband could be found at 903 Feliz Drive Apartment A. Deputies went to the location with probable cause to arrest the husband for spousal abuse and assault with a deadly weapon. Officials said he was found inside the home.
As deputies attempted to take the husband into custody, they said he physically resisted arrest. A struggle ensued and a deputy deployed a Taser on the man. Officials said he continued to physically resist arrest after the Taser deployment.
A Kern County Sheriff’s Office K-9 was utilized and bit the man on the right leg, allowing deputies to take him into custody, officials said. But then deputies noticed the man was having difficulty breathing.
Officials said deputies removed the man’s handcuffs and called for medical aid. TThe man stopped breathing and deputies administered C.P.R. Medical aid transported the man via ambulance to Kern Medical Center where he was pronounced dead by medical staff.
Officials said no deputies were injured during the incident and identified the deputies involved in the incident are: Sergeant Otis Whinery a 24-year veteran. Senior Deputy Douglas Jauch K-9 Handler an 8-year veteran. Deputy Edward Tucker a 12-year veteran. Deputy Patrick McNeal a 6-year veteran.
The Coroner’s office has scheduled an autopsy for Friday. This incident is currently under investigation.
On January 11, 2009, Rodolfo Lepe, 31, died after a struggle with Bakersfield police officers. A Taser was also deployed on him.
